The petitioner in this case was a US citizen who filed a petition on behalf of his adult married child and the child’s family. The I-130 petition was approved in 2010 and forwarded to the National Visa Center. Due to the tremendous backlog for this visa category, it was not until several years ago that the applicants were able to begin uploading documents to the NVC.

The case then became documentary-qualified. Unfortunately, the petitioner passed away before the applicants could attend their visa interview.

When this happens, the pending application is automatically revoked as a matter of law. Fortunately, the applicant’s sister reached out to HIL, and we knew exactly what we had to do - file a humanitarian reinstatement request 🙏. With the help of the applicant’s sister as a substitute financial sponsor, we were able to ask USCIS to reinstate the petition. The application focused on hardship to the surviving spouse and other humanitarian factors. We are very happy to report that the case has been reaffirmed after close to a year-long wait and having had to fight two courtesy letters from USCIS requesting additional evidence. This means that the case will be returned to the Department of State and the applicants will be able to continue their visa processing and not lose out on the many years they have been waiting for. We love stories like this and helping our clients to achieve their American Dream 💙!
